Drug Industry Immunity

1) Sen. Kahn, you recently claimed that Michigan’s drug industry immunity law is not absolute and allows those killed and injured by deadly drugs to hold drug makers accountable.  Why then do drug industry industry attorneys in the Pharmaceutical and Medical Device Law Bulletin refer to our law as  “Michigan’s absolute FDA compliance defense?”

 

2) Sen. Kahn, you recently stated that Michigan’s ‘FDA defense law’ has been copied in Arizona, New Jersey, Ohio, Oregon, North Dakota, Utah, etc.

Why is it that industry attorneys in the Pharmaceutical and Medical Device Law Bulletin say that “Michigan is the only state” to have such a law and that “with the exception of Michigan, no other state” has created such an immunity.  Why would industry lawyers make those statements if it were not the truth?

3) Sen. Kahn, you and a few isolated members of the Senate Leadership have stated that drug industry immunity ‘creates and protects jobs.’

Why that is since this law was enacted in 1996 thousands of Pharmaceutical jobs has fled Michigan?  Why did Pfizer take 2700 jobs from Michigan and move them to New Jersey and Connecticut, states that do not have drug industry immunity laws?
